What are the Different Types of Probates in Oklahoma?

In addition to “regular” or “full” probates in Oklahoma, which we’ve discussed HERE, there are some additional types of probates that may be a better option if circumstances allow. Read on to learn more about these different types of probates!

Let’s take a look at the two additional types of probates: Summary Administration and Ancillary Probate.

Summary Administration:

You can think of Summary Administration as a shortened probate—it’s been condensed into a much shorter time-frame and has fewer documents to file with the court. This type of probate can only be used in three circumstances:

  1. If the value of the assets in the estate do not exceed $200,000; or

  2. If the decedent has been deceased for at least 5 years; or

  3. If the decedent resided in another state at the time of their passing.

Ancillary Probate:

This type of probate can be used if the decedent’s estate has already been probated in another state but they owned real property in Oklahoma. Under an Ancillary Probate, the court in Oklahoma relies on the probate from the other state to distribute the property located in Oklahoma in the same way. Note that there are some additional limitations to this type of probate.
